- Management Of Imported Unregistered FDA Regulated Products In Ghana Through An Effective Warehouse Management System
The Food and Drugs Authority (FDA) is mandated by Parts, Six (6), Seven (7) and Eight (8) of the Public Health Act 2012, Act 851 to enforce standards for the safety, efficacy and quality of food, herbal medicinal products, human and veterinary medicines, medical devices, cosmetics and household chemical substances as well as tobacco and conduct of Clinical Trials.
Traditionally, three major options have been available to the regulatory authority with regards to dealing with imports that are not compliant to current regulations; i.e. re-export, destroy/safely dispose or detain the product and brought into compliance.
The FDA detains unregistered imported FDA regulated products in the importer’s warehouses until the importer brings the product into compliance with the requisite regulations. Such products in several instances have been sold or distributed without the approval of the FDA. This contravenes provisions of ACT 851 and may endanger the health of consumers.
Expressions of Interest (EOIs) are hereby invited for leasing of warehouse with floor space of at least One Thousand Square Meters (1000 m2) from any interested locally registered warehouse (dry and/or cold storage) owners/operators in the Greater Accra and the Ashanti Regions having clear and absolute title for lease out of their premises with approved building plans issued by local authority for use as warehouse of FDA regulated products. Interested warehouse owners/operators should provide information stated below:
1. Proof of ownership including Valid Building Permit, Site Plan, Building Plan(s) of the warehouse including measurements and openings of warehouse and utility services.
2. The experience of the firm in relation to warehouse management system.
3. The financial capacity of the firm evidenced by Proof of Annual Financial Turnover equal to GHS 300,000.00 in each of the last three (3) consecutive financial years.
4. Evidence of official incorporation of firm as well as Valid Tax Clearance, VAT and SSNIT Certificates.
5. Evidence of regulatory documents, i. e, Valid Ghana National Fire Services (G.N.F.S) Fire Safety Certificate, copy of comprehensive insurance policy against fire, theft and natural disasters and Valid Warehouse License from the Food and Drugs Authority
