The Government of the Republic of Ghana has received financing from the World Bank toward the cost of the eTransform Project, and intends to apply part of the proceeds for consulting services.

The consulting services (“the Services”) include the review the existing legal and regulatory framework as well as to identify gaps in the various laws and advise and make recommendations on the development of a comprehensive legislative and regulatory framework for the efficient implementation and operation of electronic transactions in Ghana, taking into consideration international best practice.
The consultancy firm will be expected to provide an overview of current international best practices with regard to developing a legislative and regulatory framework for the operation of electronic transactions as it pertains to the ICT Sector and Key Service Providers and identify gaps and recommend enhancements to the Ghanaian legal and regulatory enabling environment. The review should particularly focus on demand-side issues (such as data protection, privacy, content regulation, cybersecurity, digital ID, consumer protection etc) rather than supply side issues relating to market structure.

This assignment is focused on supporting the development and review of a legal, regulatory and policy framework governing the ICT Sector, with reference also to fiscal implications, to ensure they are suitably positioned to facilitate electronic business in government. Ministries, Departments and Agencies (MDAs) to be covered by this review include:-

a) Ministry of Communications
b) Data Protection Commission
c) National Communications Authority
d) National Information and Technology Agency
e) Ghana Revenue Authority
f) Registrar Generals’ Department
g) GIFEC
h) Cybersecurity Emergency Response team (CERT)
In addition to the ICT Sector Agencies listed above, the following key MDA service providers (Key Service Providers) are at various stages of implementation of the electronic transformation agenda, namely:

a) Ghana Immigration Service
b) Ghana Education Service and
c) Ghana Health Service
d) Parliament of Ghana
e) The Judicial Service of Ghana
f) Public Procurement Authority
g) Electoral Commission of Ghana
h) Banking- Electronic payment and related protects
i) Consumer protection
j) Cybersecurity and National security agencies
k) Various other MDAs with a presence on the eServices Platform
The Ministry of Communications now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. The shortlisting criteria are:

• Knowledge/expertise in the area of preparation and the design of best practice policy and regulatory frameworks electronic transaction.
• Knowledge/experience in drafting legal instruments (including bills, regulations etc.) and conducting multi-party stakeholder consultations.
• Ability to work effectively with high-ranking national and regional government officials.
• Professional experience in supporting the execution of large legal reform related initiatives that have national and regional wide scope.
• Previous experience working on donor funded projects; and
• The demonstration that the firm has appropriate experts to undertake the assignment.
