The Ministry of Lands and Natural Resources has received financing from the World Bank toward the cost of the Second Land Administration Project (LAP-2), and intends to apply part of the proceeds for consulting services.

The consulting services (“the Services”) include producing reports of landmark judgments on land cases speedily.

LAP-2 is a follow on project of LAP-1 and is being implemented based on the National Land Policy which came into effect in 1999. The Project concentrates on completing outstanding legal and institutional reforms, removing business bottlenecks, promoting transparency and addressing various land administration challenges with the view to: (i) speeding up land registration and delivery of titles and deeds; (ii) enhancing security of tenure; and (iii) strengthening the settlement of land disputes, among others. The Project also supports the completion of the Land Bill, engaging in legislative and institutional reforms started under LAP-1. The Project is being implemented through four-interrelated Components, namely:

1. Strengthening the Policy, Legal and Regulatory Framework for Land Administration;
2. Decentralizing and improving Business and Service Delivery Processes;
3. Providing improved Maps and Spatial Data for Land Administration; and
4. Engaging in Human Resource Development and Project Management.

To achieve the above aims, the LAP-2 Project is assisting the Judicial Service to collate landmark land cases in the Superior Courts of Judicature for publication in a specialized report.

The objective of this consultancy assignment is to produce reports of landmark judgments on land cases speedily.



SCOPE OF SERVICES

The scope of Services of the assignment shall be as follows:

a. Liaise with the Registrars of the under listed Superior Courts to take inventory and group the land cases according to their year of adjudication from 1998 to 2012 (a period of 15 years). Where electronic copies of such cases are available, the Consultant should record and file electronically.
• the Supreme Court;
• the Courts of Appeal (Accra, Kumasi and Cape Coast);
• the Specialized Land Courts;
• the Fast Track Courts; and
• all High Courts in Accra and the various Regions.

b. Establish criteria for the selection of cases to be included in the report; prioritizing landmark judgments on land cases which modify, or which clarify an existing principle of the practice of land law in Ghana.

c. Edit the judgments on land cases into a law reporting form consistent with the acceptable standards in Ghana
