1.0 BACKGROUND

i. The Government of Ghana has received credit from the International Development Association (IDA) towards the cost of implementation of Ghana Secondary Cities Support Programme (GSCSP) and intends to apply part of the proceeds to eligible payments under the Contract for Consulting Services for the Design and Supervision of Urban Infrastructure Delivery. The original Programme credit in the sum of One Hundred Million US Dollars (US$100 million) was to be implemented over a period of five years (FY2019-2023) covering the implementing agencies (IAs) of Ministry of Local Government, Decentralisation and Rural Development (MLGDRD), Office of the Head of Local Government Service (OHLGS), ten (10) Regional Coordinating Councils (RCCs) and twenty-five (25) selected Municipal Assemblies (MAs) across the country. Following the Mid-Term review of the GSCSP in March 2022, Additional Financing (AF) in the sum of about One Hundred and Forty-Five Million US Dollars (US$145 million), is to be provided to cover additional six (6) RCCS and ten (10) MAs together with the original implementing agencies (IAs) up to FY2025. The Additional Financing increases the total number of implementing agencies (IAs) from 37 to 53, made up of MLGDRD, OHLGS, sixteen (16) RCCs and thirty-five (35) selected MAs.

ii. The main objective of the Programme is to improve urban management and basic urban services in participating Municipal Assemblies (MAs). The Government of Ghana (GoG) has designed the GSCSP as part of the overall effort to promote, in secondary cities and towns (i) urban economic development, (ii) urban planning, (iii) urban infrastructure and service delivery, (iv) urban governance and (v) urban finance, through fiscal decentralisation, administrative decentralisation and decentralised planning. More details on the Programme are provided in the Programme Appraisal Document (PAD) and the Programme Operational Manual (POM).

2.0 OBJECTIVE OF THE ASSIGNMENT
In order to achieve the Project Development Objectives (PDOs), the Ministry seeks to engage the services of qualified Individual Consultants to provide technical support to MLGDRD in the positions outlined below:

1. Capacity Building and Institutional Development Specialist
2. Financial Management Specialist
3. Civil Engineer and Contract Management Adviser
4. Environmental, Health and Safety Safeguards Specialist
5. Social Safeguards Specialist

The Terms of Reference (ToR) outlines the profile of the Individual Consultants, the administrative arrangements, responsibilities, and deliverables of the position.

DURATION OF THE ASSIGNMENT
All positions are full-time and contract duration shall be for an initial twelve (12) months from the date of contract signature for all positions and renewable up to a minimum of four (4) years upon satisfactory performance.

SELECTION PROCEDURES
The Individual Consultants will be selected in accordance with the procedures outlined in the World Bank’s “Procurement Regulations for the Selection of Individual Consultants” and the Government of Ghana procurement laws.

DUTY POST FOR POSITIONS
All Individual Consultants will be based at the Ministry of Local Government, Decentralisation and Rural Development (MLGDRD), with frequent field visits to the MAs as and when needed. MLGDRD will provide the necessary logistical support to facilitate the performance of the duties assigned.


3.0 SCOPE OF ASSIGNMENTS AND KEY RESPONSIBILITIES

A. CAPACITY BUILDING AND INSTITUTIONAL DEVELOPMENT SPECIALIST
The Capacity Building and Institutional Development Specialist will lead and coordinate the conduct of the Annual Performance Assessment (APA) of the participating agencies (MLGDRD, OHLGS, RCCs, and MAs), preparation and collation of Annual Work Plans and the development of human and institutional capacity to facilitate the implementation of the programme activities.

Activities to be performed by the Capacity Building and Institutional Development Specialist include, but are not limited to the following:

 Develop, implement, and monitor the capacity development strategy to support the MLGDRD, OHLGS, the RCCs and MAs for the implementation of the program;
 Conduct detailed institutional capacity assessment and develop action plan with budget for the roll-out of capacity development training activities, including the methodology and framework for monitoring and evaluation;
 Design, coordinate, and deliver tailored institutional development initiatives, together with the programme consultants to the RCCs and MAs;
 Provide technical inputs for monitoring and evaluation of all institutional reform and development activities under the programme;
 Coordinate the conduct of the Annual Performance Assessment (APA) by the Individual Verification Agent (IVA) and collate results for funds allocation;
 Support the MAs to prepare annual strategic plans including the Urban Development Action Plans (UDAP);
 Assist in the development of composite programme Annual Work Plan (AWP) and oversee the preparation of documentation in support of AWP.
 Work closely with the M&E Specialist to ensure that M&E data regarding the Annual Performance Assessment are delivered in a timely manner and in an appropriate format;
 Conducts investigations that aim at institutional development and continuous improvement of the performance in the Annual Performance Assessment;
 Provide inputs on capacity development activities, including the achievement of outputs and outcomes for the preparation of mid-year, and annual progress reports;
 Carry out any other relevant duties that may from time to time be assigned by the Chief Director through the Director Policy Planning, Budgeting, Monitoring and Evaluation (PPBME)

Qualifications and Professional Experience
The Capacity Building and Institutional Development Specialist will need to demonstrate the following qualifications and expertise:
 Master’s Degree in Development Planning and Management, Public Administration, Political Science, Economics, Social Sciences, or related fields;
 Ten (10) years of professional experience in project management, strategy formulation, planning, development and capacity building, public sector modernisation, including at least 5 years working with government agencies and/or international organisations.
 In-depth knowledge and demonstrated experience in at least two (2) donor funded assignments related to formulation of Capacity Development Strategy, conducting institutional capacity assessments, and preparation of capacity development plans.
 Familiarity with the decentralisation and local governance processes, systems and structures.
 Excellent oral and written communication skills, and familiarity with relevant computer software (MS Word, PowerPoint, Excel, etc).

B. FINANCIAL MANAGEMENT SPECIALIST
The Financial Management Specialist will lead, manage, monitor and coordinate all the financial management activities and ensure compliance with the programme disbursement arrangements by the implementing agencies (MLGDRD, the OHLGS, RCCs and MAs).
Activities to be performed by the Financial Management Specialist include, but are not limited to the following:

 Establish the financial management strategy for the efficient use of programme financial resources at the national, regional, and local levels;
 Implement all financial aspects of the financing agreement and the strategic plan in order to achieve relevant objectives as well as provide financial and accounting advice;
 Collate and prepare programme annual budget based on the Work Plan and Cashflow Plan and periodically update where necessary;
 Manage the budgetary process in close collaboration with the programme team, including, budget monitoring and forecasts and prudently execute budgets;
 Prepare monthly monitoring reports compare actual expenditure against the budget and identify the challenges for attention by management;
 Conduct financial analysis, prepare detailed financial reports and statements and establish and maintain cash controls;
 Prepare and process withdrawal applications in accordance with the programme disbursement arrangements
 Ensure compliance with the country disbursement arrangements outlined in the Programme Operational Manual
 Apply pre-audit checks to all payments and maintain accounts on modified accrual basis as per country accounting procedures
 Ensure up-to-date maintenance of adequate registers, books of accounts and records in appropriate order and format to facilitate classification and analysis, the financial information in monitoring disbursement progress
 Maintain imprest of petty cash and ensure maintenance of separate petty cash books and petty cash vouchers
 Prepare monthly bank reconciliation statements and ensure safe custody of all financial records for review by third party monitoring agents, internal and external auditors
 Make arrangements for timely initiation and completion of programme audit and ensure that reports produced in compliance with audit requirements
 Assist the programme team with the preparation of monthly, quarterly and annual financial reports for submission to management and the World Bank
 Assess the adequacy of the RCCs and MAs capacity for the efficient management of programme funds and make appropriate recommendations to address it;
 Conduct training to enhance capacity of the RCCs and MAs in the programme financial management requirements and monitoring protocols;
 Undertake field visits to collect/validate data on programme funds disbursement at the national, regional, and local levels;
 Serve as the liaison between MLGDRD, OHLGS, the RCCS, MAs, and the World Bank on all programme financial management matters;
 Carry out any other programme related duties that may be assigned by the Chief Director through the Director PPBME as and when required.

Qualifications and Professional Experience
The Financial Management Specialist will need to demonstrate the following qualifications and expertise:
 Bachelor’s Degree in Economics, Finance, or Business Administration
 Master’s Degree in Business Administration;
 Professional accountant (e.g. CA (Gh), CA, ACCA, CIMA);
 A minimum of twelve (12) years of relevant professional experience in public financial management, six (6) of which should have been in a senior management position;
 Specific experience in at least two (2) donor funded assignments of similar nature and complexity (multi-disciplinary project) involving MMDAs;
 Proven knowledge in the country regulations and legal framework for public financial management;
 Proven experience in the World Bank guidelines, procedures, and financial reporting;
 Excellent oral and written communication skills, and familiarity with relevant computer accounting software, MS Word, PowerPoint, Excel, etc.

C. CIVIL ENGINEER/CONTRACT MANAGEMENT ADVISER
The Civil Engineer and Contract Management Adviser will lead, manage, monitor, and coordinate tasks related to contracts awarded for the procurement of goods, works and consulting services at MLGDRD and the 35 participating MAs. Will further ensure that the designs, estimates of infrastructure investments and contract management activities are performed in a professional, transparent, and ethical manner, and in line with regulations and guidelines of the programme.

Activities to be performed by the Civil Engineer and Contract Management Adviser include, but are not limited to the following:
i. Pre-Contract Stage
 Coordinate and review architectural/engineering studies, design drawings, technical specifications submitted by private consultants engaged by the MAs;
 Collaborate with the Procurement, Social Safeguards Specialist, Environmental, Health and Safety Specialist to review tender documents and ensures that all the relevant provisions/sections have been provided;
 Collaborate with the Procurement Specialist during the tender evaluation process to ensure that adequate considerations (tender evaluation criteria) are taken into account in the selection of the successful tender;

ii. Post- Contract Stage
 Develop, implement, and monitor contract management strategy at the RCCs and MAs to ensure speedy contract execution and performance by vendors (contractors, suppliers, consultants);
 Coordinate the preparation of programme contract status reports for management by collecting, analysing and summarising information and trends and recommending actions;
 Assess and advise on all proposed technical issues regarding cost and time variations (amendments), justification or otherwise of claims by contractors, contract remedies in event of poor performance, and dispute management;
 Advise and provide technical support to the RCCs and MMAs to ensure that:
 invoices are promptly verified and authorisation for payments are consistent with contract terms,
 financial implications of contract changes, in terms of original costs and available budget are minimised
 Serve as liaison between the MLGDRD and the RCCs and MAs on all matters relating to contract management for prompt resolution;
 Liaise with the Environmental and Social Specialists to monitor contract executions to ensure that the appropriate safeguards requirements are complied with by the contractors;
 Advise and provide technical support to the RCCs and MAs to effectively manage the contract close-out process, by ensuring that:
 contract files contain all necessary contract documentation from contract initiation through to completion and close-out;
 financial securities (performance bonds, advance payment bonds) are liquidated;
 final acceptance certificate and contract performance reports are issued.
 Provide training and capacity building needs of staffs of the RCCs, and MMAs for the smooth implementation and management of contracts;
 Participate in the Joint World Bank and Government of Ghana Implementation Support Missions to monitor and evaluate programme progress;
 Carry out any other relevant duties that may from time to time be assigned by the Chief Director through the Director PPBME.
Qualifications and Professional Experience
The Civil Engineer and Contract Management Adviser will need to demonstrate the following qualifications and expertise:
 Bachelor’s degree in Civil Engineering is mandatory;
 Master’s degree in Civil Engineering, Construction Management, Project Management, or related field;
 Ten (10) years of professional experience in the construction industry in the public or private sector, of which at least five (5) years should be directly related to first-hand procurement and/or contracting experience on projects;
 Specific experience in at least two (2) donor funded assignments of similar nature and complexity (multi-disciplinary project) involving MMDAs;
 Proven knowledge in the country regulations and legal frameworks for public procurement management;
 Proven experience in the World Bank procurement guidelines, procedures, and reporting;
 Excellent oral and written communication skills, and familiarity with relevant computer software (MS Word, PowerPoint, Excel, etc).

D. ENVIRONMENTAL, HEALTH, AND SAFETY SAFEGUARDS SPECIALIST
The Environmental, Health and Safety Safeguards Specialist will lead in the provision of technical guidance, backstopping and mentorship on environmental (including climate change and disaster risk Management), health and safety issues at MLGDRD, OHLGS, the RCCs and the 35 participating MAs. Will ensure compliance with Ghana’s environmental (including climate change and disaster risk management), health and safety requirements, as well as assisting Environmental Protection Agency in reviewing environmental management instruments prepared for projects under the Programme. Additionally, the Environmental, Health and Safety Safeguards Specialist will collaborate with the requisite regulatory institutions to facilitate the processing and issuance of environmental permits for projects and conduct compliance monitoring of project safeguards implementation activities.

Activities to be performed by the Environmental, Health and Safety Safeguards Specialist include, but are not limited to the following:

 Lead and coordinate the programme’s environmental (including climate change and disaster risk management), health, and safety safeguards implementation activities of MLGDRD and provide technical support to the MAs for their safeguard activities;
 Provide guidance and technical backstopping to safeguards outreach, educational, mentoring and capacity building programmes at MLGDRD, RCCs and MAs;
 Assist with the preparation of Terms of Reference (TOR) for the selection of consultants to conduct environmental (including climate change and disaster risk management), health, and safety safeguards studies and preparation of appropriate instruments (eg: Environmental and Social Management Plans);
 Provide technical backstopping in the preparation of Environmental and Social Management Plans (ESMPs), Construction Environmental and Social Management Plans (C-ESMPs), Health and Safety Plans (H&S Plans) and coordinate their implementation;
 Assist in the review of Environmental and Social Impact Assessment (ESIA), Environmental and Social Management Plans (ESMPs), Programme Environmental Plan (PER) in close collaboration with EPA and other relevant regulatory agencies;
 Facilitate the review, clearance and permitting of environmental safeguards instruments (i.e. PER/ESIA/ESMP) prepared by private consultants or MA Technical Teams by the Environmental Protection Agency (EPA)
 Ensure that the environmental safeguards measures prescribed in the subprojects safeguards instruments are comprehensively enforced by the MAs. These include ensuring that the appropriate subproject specific safeguards requirements are incorporated in the design, implementation plan, the tender documents (Technical Specifications and Bills of Quantities) and contracts;
 Assist with the development of environmental (including climate change and disaster risk management), health and safety safeguards data capturing protocol for the programme Monitoring and Evaluation ( M&E) system,
 Provide input on environmental (including climate change and disaster risk management), health and safety safeguards implementation activities for the preparation of periodic reports, including quarterly and annual progress reports;
 Undertake periodic compliance monitoring of progress of implementation of environmental (including climate change and disaster risk management), health and safety measures related to the subprojects.
 Assess the adequacy of MAs capacity for the implementation of environmental (including climate change and disaster risk management), health and safety safeguards measures and make appropriate recommendations to address it;
 Conduct training to enhance the capacity of the MAs in environmental (including climate change and disaster risk management), health, and safety safeguards requirements and monitoring protocols;
 Undertake field visits to collect/validate data on environmental (including climate change and disaster risk management), health, and safety safeguards implementation and assess whether subproject safeguards requirements are being complied with during the construction phase;
 Ensure that grievance redress mechanisms are put in place for each subproject and are functional;
 Facilitate close collaboration and serve as liaison between MLGDRD, World Bank, EPA, Land Valuation Division (LVD), Land Use and Spatial Planning Authority (LUSPA), participating MAs and contractors on all environmental, health, and safety safeguards matters;
 Carry out any other programme related duties that may be assigned by the Chief Director, through the Director, PPBME as and when required.

Qualifications and Professional Experience
The Environmental, Health and Safety Safeguards Specialist will need to demonstrate the following qualifications and expertise:
 Master’s Degree and above in a relevant field of study such as Natural Resources Management, Environmental Science or Environmental Management,
 Ten (10) years of professional field experience in environmental, health, and safety safeguards management and supervising the preparation and review of Environmental Safeguards instruments particularly in developing tropical countries
 Specific experience in at least two (2) donor funded assignments of similar nature and complexity (multi-disciplinary project) involving MMDAs;
 Proven knowledge in Ghana’s Environmental Assessment regulations and legal frameworks;
 Proven experience in implementing World Bank Environmental Management Frameworks and Policies;
 Knowledge of Ghana’s climate change adaptation and environmental resilience strategies
 Excellent oral and written communication skills, and familiarity with relevant computer software (MS Word, PowerPoint, Excel, etc).

E. SOCIAL SAFEGUARDS SPECIALIST
The Social Safeguards Specialist will lead, manage, monitor and coordinate programme activities related to land acquisition and resettlement of Project Affected Persons (PAPs). Will further ensure compliance with the arrangements outlined in the Programme Resettlement Policy Framework and other applicable laws.

Activities to be performed by the Social Safeguards Specialist include, but are not limited to the following:

 Lead and provide technical guidance and backstop the Programme’s safeguards teams at the MAs and PPMED Directorate of MLGDRD,
 Assist with the preparation of Terms of Reference (TOR) for the selection of consultants to conduct social safeguards studies for the preparation of appropriate instruments (Abbreviated Resettlement Action Plan, Resettlement Action Plan);
 Review the social safeguards instruments (ARAP, RAP) prepared by consultants to ensure compliance with Programme Resettlement Policy Framework (RPF) and quality of instruments
 Facilitate the clearance of social safeguards instruments (ARAP, RAP) prepared by consultants by World Bank
 Ensure that the social safeguards measures stipulated in the ARAP and RAP are comprehensively enforced by the MAs. This includes ensuring the appropriate implementation of safeguards measures relating to physical or economic displacement, gender-based violence, inclusive public consultation, grievance redress for affected persons and mitigation and management of other potential social impacts/risks associated with sub-projects;
 Assist with the development of social safeguards data capturing protocols for the programme M&E strategy, establish and generate accurate data on all social safeguards matters in the MAs;
 Provide input on social safeguards implementation activities for the preparation of periodic reports, including quarterly and annual progress reports;
 Undertake periodic field compliance monitoring of progress of implementation of social safeguards instruments, including lessons learned;
 Assess the adequacy of MAs capacity for the implementation of social safeguards measures and make appropriate recommendations to address it;
 Conduct technical training to enhance capacity of MAs in social safeguards requirements and monitoring protocols;
 Undertake field visits to collect and validate data on social safeguards implementation related to timeliness of compensation payments to PAPs, effectiveness and timeliness in addressing grievances at the MAs and subproject sites and communities
 Facilitate cooperation and serve as the liaison between MLGDRD, World Bank, EPA, LVD and MAs and contractors on all social safeguards matters;
 Carry out any other programme related duties that may be assigned by the Chief Director through the Director, PPBME as and when required.

Qualifications and Professional Experience

The Social Safeguards Specialist will need to demonstrate the following qualifications and expertise:

 At least Master’s Degree and above in a relevant field of study such as Anthropology, Sociology, Applied Social Science, Environmental Science or other related fields
 Ten (10) years of professional field experience in social safeguard management, implementation of Programme/Project resettlement frameworks, supervising the preparation and review of Resettlement Action Plans (RAP) and Abbreviated Resettlement Action Plans (ARAP) of subprojects
 Specific experience in at least two (2) donor funded assignments of similar nature and complexity (multi-disciplinary project) involving MMDAs;
 Proven knowledge in the country regulations and legal frameworks regarding resettlements
 Proven experience in World Bank guidelines and procedures on involuntary land acquisition and displacements, social impact assessment, social analysis, stakeholder engagement and grievance redress mechanisms;

Proven knowledge in the country regulations and legal framework regarding resettlements as well as World Bank guidelines and procedures on involuntary land acquisition and displacements, social impact assessment, social analysis, stakeholder engagement and grievance redress mechanisms; Ten (10) years
Excellent oral and written communication skills, and familiarity with relevant computer software (MS Word, PowerPoint, Excel, etc). Five (5) years

4.0 EXPRESSION OF INTEREST
The Ministry of Local Government, Decentralisation and Rural Development (MLGDRD) now invites eligible Individual Consultants to indicate their interest in providing these services. Interested Consultants must provide information through Curriculum Vitae and other means, indicating their qualifications and relevant experience to perform the assignment. The selection will be carried out through open competition among shortlisted individual consultants. Interested Individual Consultants may obtain further information at the address (2) below and not later than Wednesday, 18th April, 2023.

Five (5) hard copies of the Expressions of Interest must be delivered to the address (1) below by 17.00 Hrs GMT on Wednesday, 26th April 2023, in a separate sealed envelope clearly marked for the position (i.e. “Procurement Specialist’ and the name of the Project, “Ghana Secondary Cities Support Programme (GSCSP)”.
