Request for Expression of Interest

This request for expression of interest follows the general procurement notice for this project that appeared in Development Business No. 45233120 of 20th April, 2009.

The Ministry of Transport (MOT) of the Republic of Ghana has received a credit from the International Development Association (IDA) to support projects being implemented by its agencies, and intends to apply part of the proceeds of this credit to payments under Consultancy Services for the Review and Development of Regulations for the Ghana Civil Aviation Authority.


The services include but not limited to the following:

• Review the existing regulations in Ghana and their suitability to fulfill the regulatory role described for GCAA.
• Review air transport regulations in a number of countries with similar background, policy, governance, financing and institutional arrangements and with similar development objectives to that of Ghana; examining their suitability to the Ghanaian context.
• Present the analysis, identifying gaps and recommend options to the MOT and GCAA, Attorney-General’s Dept, existing and potential service providers, investors and other relevant stakeholders, in a workshop environment.
• Detailed development of regulations in three (3) areas:
1. Economic regulations including:
 Guidelines and regulations governing operations of airports and air navigation services to ensure: Non-discrimination in the application of charges; No overcharging or anti-competitive practices or abuse of dominant tion; Transparency as well as the compilation (or collection), the availability and presentation of all financial data required to determine the basis for charges; Efficiency and efficacy in the operation of providers and the way in which they are measured.
 Standards for quality and level of service to be provided by suppliers and the criteria by which they are measured.
 Measures and criteria to improve and encourage investments to meet future demand.
 Measures that ensure user views are adequately taken into account.
 Fees and charges levied by the CAA, airports and ANSP.

2. Air transport regulations including:
 Civil aviation (air transport licensing) regulations for both scheduled and non-scheduled services.
 For domestic and foreign air carrier operations
 Consumer protection regulations for users of all aviation services (airlines, airports, air navigation services, allied service providers). in respect of airlines, to draw a distinction between domestic and international flights.
 Airport and air carrier liability regulations.
 Measures and sanctions for all regulations for breaches and non-compliance

3. Adoption of ECOWAS regulations including:
 Compensation for denied boarding, flight delays, flight cancellation, distinguishing between domestic and international flights.
 Slot allocation;
 Ground handling;
 Market access;
 Approval of air carriers;
 Air tariffs;
 Liability of air carrier in case of accident, distinguishing between domestic and international flights.
 Exemptions on rules of competition in matters of air transport.

The assignment will be implemented in the period from January, 2013 – June, 2013.


The Ministry of Transport on behalf of the Ghana Civil Aviation Authority now invites eligible consultants to indicate their interest in providing the services. Interested consultants must provide information indicating that they are qualified to perform the services (brochures, description of similar assignments, experience in similar conditions, availability of appropriate skills among staff, etc.). Consultants may associate to enhance their qualifications.

A consultant will be selected in accordance with the procedures set out in the World Bank's Guidelines: Selection and Employment of Consultants by World Bank Borrowers May 2004 Revised October 1, 2006, however, the subsequent improvement presented in May 1, 2012 and January 2011 guidelines regarding Fraud and Corruption, Audit Rights, and Cross Debarment will be applicable.
