Consultancy Service for the Preparation of Legislative Instruments for the Lands Commission Act, 2008 (Act 767) and the Office of Administrator of Stool Lands Act, 1994 (Act 481).

The Ministry of Lands and Natural Resources has received financing from the World Bank toward the cost of the Second Land Administration Project (LAP-2), and intends to apply part of the proceeds for consultant services.

LAP-2 is a follow on project of LAP-1 and is being implemented based on the National Land Policy which came into effect in 1999. The Project concentrates on completing outstanding legal and institutional reforms, removing business bottlenecks, promoting transparency and addressing various land administration challenges with the view to: (i) speeding up land registration and delivery of titles and deeds; (ii) enhancing security of tenure; and (iii) strengthening the settlement of land disputes, among others. The Project also supports the completion of the Land Bill, engaging in legislative and institutional reforms started under LAP-1. The Project is being implemented through four-interrelated Components, namely:

1. strengthening the Policy, Legal and Regulatory Framework for Land Administration;
2. decentralizing and improving Business and Service Delivery Processes;
3. providing improved Maps and Spatial Data for Land Administration; and
4. engaging in Human Resource Development and Project Management.

The objective of the consultancy is to formulate the appropriate subsidiary legislations required to implement the provisions of Act 767 and Act 481 and facilitate the process for the consideration of the regulations by Parliament.

The consulting services (“the Services”) include:
a. review the drafting process so far initiated, review existing documents to be provided by the client, and provide a road map (including proposed schedule, methodology and consultation strategy) for completing the drafting process;
b. work in collaboration with the LC and OASL to formulate the appropriate LIs to implement the Lands Commission Act, (Act 767) and the Office of the Administrator of Stool Lands Act (Act 481) ;
c. identify critical issues that require further consultations by key stakeholders as input into further development of the LIs;
d. work in regular consultation with the Attorney General’s Department and the Legal Department of the Lands Commission and other stakeholders;
e. facilitate public consultations on the drafts and incorporating key and relevant proposals into the LIs. A wider stakeholder group including Staff of these Agencies, Traditional Authorities (Chiefs and Queen Mothers), land owners, farmers, District Assemblies, Civil Society Organisations, service providers, estate developers, vulnerable groups and other key stakeholders are expected to be consulted;
f. draft relevant memoranda for forwarding the legislative instruments to the Office of the President;
g. assist the Client during the consideration of the regulations by Parliament; and
h. prepare abridged versions of the LIs to facilitate Staff and public education

The assignment will be executed over a total of 6 months utilizing 6 man-months.

The Ministry of Lands and Natural Resources through the Project Coordinating Unit now invites eligible Individual consultants to indicate their interest in providing the services. Interested consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. The shortlisting criteria are:
a. relevant experience, qualifications, and capability to carry out the assignment;
b. experience of similar assignments and conditions.

The Individual Consultant must be a Drafting Expert with proven record in legislative drafting with at least 10 years experience in the field of legislative drafting and land law. Must have experience in customary land tenure issues and dispute resolution in the Ghanaian context as well as relevant dimensions of Ghanaian law, including the interface between customary and statutory norms. Must be knowledgeable in international trends, innovations and norms relevant to national land law frameworks and legislative instruments.

Firms may provide qualified individual consultant for the assignment and contract will be signed with the firm.
